Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Revulance platform, website, and related services (collectively, the "Service") operated by Revulance ("we," "us," or "our"). By creating an account, accepting an invitation, or using the Service, you agree to be bound by these Terms and our Privacy Policy.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Description of Service

Revulance is a software-as-a-service platform that enables agencies and businesses to:

  • Manage multiple businesses and user accounts
  • Import and organize customer records
  • Send review request and reminder emails through integrated email providers
  • Track email engagement and customer status
  • Configure campaigns, templates, and send limits
  • Monitor business health and platform analytics

We may modify, suspend, or discontinue features of the Service at any time with reasonable notice where practicable.

Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Ensuring information you provide is accurate and current
  • Notifying us promptly of any unauthorized access or security breach
  • Using strong passwords and following platform security requirements

You must not share login credentials or allow unauthorized individuals to access the Service through your account.

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for all content uploaded, emails sent, and actions taken through your account or on behalf of businesses you manage.

Prohibited Activities

You may not:

  • Send spam, unsolicited bulk email, or messages that violate applicable anti-spam laws
  • Use the Service for any illegal, fraudulent, or harmful activity
  • Abuse, harass, or mislead recipients through review request campaigns
  • Attempt unauthorized access to the Service, other accounts, or related systems
  • Reverse engineer, scrape, or interfere with the normal operation of the Service
  • Upload malware, malicious code, or content that infringes third-party rights
  • Circumvent send limits, security controls, or role-based access restrictions

Customer Data

You retain ownership of all customer data and content you upload to the Service. By uploading data, you grant Revulance a limited license to host, process, and transmit that data solely to provide the Service on your behalf.

You are solely responsible for the accuracy, legality, and appropriateness of customer data you collect and upload. You represent that you have obtained all necessary rights, consents, and permissions required to use customer data within the Service.

Email Compliance

You are responsible for compliance with all applicable email marketing and privacy laws, including CAN-SPAM, GDPR, CASL, and similar regulations in your jurisdiction.

You are responsible for obtaining consent from recipients where required before sending review request emails. Revulance provides tools to manage unsubscribes and bounces, but compliance with applicable laws remains your responsibility.

Third-Party Integrations

The Service integrates with third-party providers such as Brevo for email delivery and event tracking. Each business may connect its own Brevo account. Third-party integrations are provided "as is" and subject to the third party's terms and availability.

Revulance is not responsible for third-party outages, API changes, delivery failures, or data processing practices of integrated services outside our reasonable control.

Availability

We strive to maintain reliable Service availability but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, infrastructure issues, or circumstances beyond our reasonable control.

We will use reasonable efforts to maintain uptime and communicate planned maintenance where practicable.

Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REVULANCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE.

TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO REVULANCE FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

Termination

We may suspend or terminate your access to the Service immediately if you violate these Terms, engage in prohibited activities, or if continued access poses a security or legal risk.

You may terminate your account by contacting us or through account management features where available. Upon termination, your right to use the Service ceases, though certain provisions of these Terms will survive termination.

Intellectual Property

Revulance retains all rights, title, and interest in the Service, including software, design, branding, documentation, and underlying technology. These Terms do not grant you any ownership rights in the Service.

You retain ownership of your uploaded data, email templates, and business content. You grant us a limited license to use this content solely to operate and improve the Service for you.

Changes to Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Material changes may be communicated through the Service or by email. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
